Acknowledgment of Risk
I, the undersigned participant (or parent/guardian of a participant), fully acknowledge that attending and/or participating in Kerr Kids events, programs, and activities involves inherent and unavoidable risks. These risks may result in injury, illness, property damage, or death, and may occur despite the best efforts of Kerr Kids staff and volunteers.
Risks include, but are not limited to:
Play & Equipment Risks: accidents, falls, collisions, entrapment, or malfunction of inflatables, bouncy castles, playground structures, games, or crafts.
Environmental Risks: uneven ground, weather changes, extreme temperatures, flooding, sunburn, dehydration, insect bites, bee stings, wild or domestic animal encounters, lightning, and other natural hazards.
Food & Beverage Risks: allergic reactions, food borne illness, contamination, or choking from food or drink provided or brought to the event.
Medical & Health Risks: aggravation of pre-existing conditions, injuries requiring treatment, delayed or unavailable emergency response, misdiagnosis, or lack of immediate medical care. I acknowledge and accept that Kerr Kids is not responsible for providing medical care or insurance, and I accept full financial responsibility for all related costs.
Communicable Disease Risks: exposure to COVID-19, flu, colds, and other viruses, bacteria, or infections.
Property Risks: theft, loss, or damage to personal belongings.
Transportation Risks: injury, accident, or delays during travel to, from, or between event locations, whether by personal vehicle, public transit, or third-party provider.
Water-Related Risks: participation may involve activities near or involving water. I acknowledge the risks of drowning, near-drowning, slips, falls, water inhalation, secondary drowning, or other water-related injuries or fatalities. I understand that Kerr Kids does not provide certified lifeguards, swim instruction, or water safety supervision and that participation is strictly at my own risk and I am responsible for supervising my own child.
Other Risks: emotional distress, psychological harm, or any unforeseen hazards not specifically listed.
Petting Zoo Acknowledgment & Release:
I understand that participation in activities involving animals, including the petting zoo, carries inherent risks. These may include, but are not limited to, scratches, bites, allergic reactions, or exposure to bacteria, viruses, or other pathogens. By choosing to participate, I assume all risks associated with contact or proximity to animals. I release and hold Kerr Kids, and Happy Tails Entertainment, its owners, employees, and volunteers from any and all liability, claims, or damages that may result from my or my child’s participation in petting zoo activities. I acknowledge that I have been advised to supervise my child(ren) at all times and to follow all posted rules and staff instructions regarding animal interaction.
Release of Liability
In consideration of being permitted to participate, I hereby voluntarily release, waive, discharge, and covenant not to sue Kerr Kids, its founders, directors, officers, employees, volunteers, property owners, partners, sponsors, or affiliates for any and all claims, demands, damages, expenses, or causes of action arising out of or connected with participation, whether caused by negligence or otherwise.
This release specifically includes claims for injury, illness, permanent disability, or death — including but not limited to water-related incidents such as drowning, near-drowning, or waterborne illness — as well as damage to or loss of personal property. I understand that this release applies to all present and future claims, including those resulting from ordinary negligence.
Indemnification
I agree to defend, indemnify, and hold harmless Kerr Kids from any and all claims, damages, costs, expenses, or liabilities (including attorney’s fees) that may arise as a result of my participation or the participation of my child(ren).
Medical Authorization
In the event of illness, injury, or emergency, I authorize Kerr Kids to secure medical treatment deemed necessary. I understand that all financial costs remain my sole responsibility, and that Kerr Kids does not provide medical insurance of any kind.
